มนุษยนิยม ศักดิ์ศรีความเป็นมนุษย์และสิทธิมนุษยชนในสังคมไทย (Humanism, human dignity and human rights in Thai society)

บทคัดย่อ

          งานวิจัยนี้เป็นการวิจัยเอกสาร (Documentary research) ผู้วิจัยให้ความสนใจศึกษาทำความเข้าใจกับแนวคิดและหลักการที่เกี่ยวข้องกับเรื่องมนุษยนิยม ศักดิ์ศรีของความเป็นมนุษย์ และสิทธิมนุษยชน โดยศึกษาเจาะลึกด้วยการวิเคราะห์เนื้อหา (Content analysis) ของรัฐธรรมนูญฉบับปี พ.ศ. 2540 ถึงฉบับปัจจุบัน ว่าได้ให้ความสำคัญกับการปกปักพิทักษ์ศักดิ์ศรีของความเป็นมนุษย์ของสังคมไทยมากน้อยเพียงใดในเชิงเปรียบเทียบ ศึกษาองค์การภาครัฐที่มีหน้าที่รับผิดชอบในการนี้ รวมทั้งศึกษาสถานการณ์ที่ข้องเกี่ยวกับสิทธิมนุษยชนในสังคมไทยระหว่างปี พ.ศ. 2560 ถึง 2564 เพื่อประเมินความสัมฤทธิผลของการบังคับใช้กฎหมายของรัฐด้วย ผลการวิจัยพบว่านักวิชาการได้ให้ความหมายของมนุษยนิยม ศักดิ์ศรีของความเป็นมนุษย์ และสิทธิมนุษยชนไว้หลากหลาย โดยภาพรวมมองว่ามนุษย์แต่ละคนต่างมีศักดิ์ศรีของความเป็นมนุษย์เท่าเทียมกัน และใครจะละเมิดไม่ได้ รัฐมีหน้าที่ที่จะต้องสนับสนุน ส่งเสริม รวมทั้งปกป้องไม่ให้เกิดการละเมิด หรือมีการรอนสิทธิที่มนุษย์พึงมี สำหรับสถานการณ์ในประเทศไทย พบว่าแม้รัฐจะกำหนดไว้เป็นกติกาในรัฐธรรมนูญ และกำหนดให้ปัญหาสิทธิมนุษยชนเป็นวาระแห่งชาติ มีหน่วยงานทั้งภาครัฐและภาคเอกชนให้ความร่วมมือสอดส่องดูแล แต่ก็พบว่ามีการละเมิดสิทธิมนุษยชน รวมทั้งการกระทำที่ส่งผลให้ศักดิ์ศรีของความเป็นคนของคนไทยด้อยค่าลงตลอดเวลา

Abstract

This research is a documentary research. The researchers are interested in understanding the concepts and principles related to humanism, human dignity and human rights. Moreover, it aimed to analyze the content (content analysis) of the Thai constitution of the year 1997 to the present to make it understandable how much emphasis has been placed on protecting the human dignity of the members of Thai society. It intended to explore the government organizations responsible for this and also included studying the situation related to human rights in Thai society between 2017 and 2021 to assess the effectiveness of state law enforcement. The results showed that scholars have given the various meanings of humanism, human dignity and human rights. Overall, they claimed that each human being has the dignity of being equal which cannot be violated. States have a duty to support, promote and prevent such violations or deprivation of the human rights. Concerning the situation in Thailand, it was found that although the state has set rules in the constitution and make human rights issues a national agenda, there are various government agencies and private sectors to cooperate and supervise, but there were violations of human rights, including actions that result in the deterioration of the dignity of the Thai people happened all the time
